These Terms and Conditions ("Terms") govern your use of the Family Doctor mobile application (the "App"), a unit of Healthsmith Private Limited. This Agreement is a legally binding contract between you ("User" or "you") and Healthsmith Private Limited, operating as Family Doctor ("Family Doctor", "we," "us," or "our"). By using the Family Doctor App and its services, you agree to be bound by these Terms. If you do not agree, do not use the App or services.

1. Services Provided

Family Doctor provides a platform to book home healthcare services across Hyderabad, including doctor consultations, nursing care at home, diagnostics, post-surgery care, follow-up care, and chronic care management. The availability of services may change at our discretion.

2. Eligibility

You must be at least 18 years old to use the App. By using it, you confirm that you meet this requirement and have the legal capacity to enter into this agreement.

3. User Account

• Registration: Provide accurate and complete information. Keep it updated.
• Security: You are responsible for your account credentials and any activity under your account.
• Termination: We reserve the right to terminate accounts without notice for any violation.

4. Appointment Booking Guidelines

• 4.1 Booking: Booking involves selecting a service, providing symptoms, choosing a time, and confirming with payment.
• 4.2 Health Assistant: May be assigned to record vitals or collect samples.
• 4.3 Medicines: Can be procured directly via the assistant or ordered through the App.
• 4.4 Diagnostic Reports: Available within the App after lab processing.
• 4.5 Nurse Visits: Users can schedule home nurse care with full details and online payment.

5. Payment

• Users must pay for all services via third-party gateways integrated into the App.
• We are not liable for failed transactions. Refunds follow the payment processor's policy.

6. Roles and Responsibilities

Family Doctor provides the platform; doctors and healthcare professionals are solely responsible for medical services and treatment quality.

7. Disclaimers

• We do not offer medical advice. Our role is facilitative only.
• We are not responsible for medical malpractice, incorrect diagnoses, or service outcomes.
• Product quality and legal compliance lie with manufacturers and providers.
• Services and content are offered "as is".

8. Privacy

By using the App, you consent to our collection and use of personal and health data as described in our Privacy Policy.

9. Limitation of Liability

Family Doctor is not liable for any direct, indirect, incidental, or consequential damages from use of the App.

10. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of the App indicates acceptance.

11. Termination

We may suspend or terminate your access without prior notice if you violate these Terms.

12. Proprietary Rights

The App, its layout, trademarks, and all intellectual property are owned by Family Doctor and may not be copied.

13. User Responsibilities

Users must provide truthful and accurate information when booking services.

14. Code of Conduct

Users must be respectful towards healthcare professionals. Disruption may result in service termination.

15. Restrictions on Use

Users must not upload illegal, offensive, infringing, or harmful content. Any such behavior will result in immediate termination.

16. Emergency Situations

This App is not intended for emergency medical services. Please call emergency services in such cases.

17. Health Records

The App may allow users to view and manage health records. We are not liable for the accuracy of user-submitted data.

18. Availability of Services

Service availability may vary depending on location, availability, and demand. We do not guarantee continuous access.

19. Indemnification

You agree to indemnify Family Doctor from all claims or damages arising from your use of the App or violation of these Terms.

20. Waiver

Failure to enforce any part of these Terms does not constitute a waiver of our right to do so in the future.

21. Governing Law & Dispute Resolution

These Terms are governed by Indian law. Disputes will first attempt mediation; failing which, arbitration will be held in Hyderabad.

22. Severability

If any part of these Terms is deemed invalid, the remainder shall still apply.
